Indochina Protocol

The Indochina Protocol

A contract willingly entered into on 1 September, between:

The Republic of France (hereafter, “France”)

and,

The Empire of Japan, Bharat, the Republic of the Philippines, the Republic of China, the Kingdom of Chosen, the Kingdom of Formosa, the Kingdom of Persia, and the Republic of Pacifica (collectively referred hereafter as “SATSUMA”)

Part 1: French Commitments

A. France commits to the thorough development of Indochina’s political infrastructure. This shall include widespread efforts to train and employ the Indochinese at all levels of government, development of policies and programs that meet the needs of the Indochinese population, and institution of values and ethics promoting responsible government.

B. France commits to the thorough development of Indochina’s economic infrastructure. This shall include development of secondary and post-secondary learning institutions and adult training programs, provision for seed capital to fund new businesses, and development of other programs as may be necessary to promote full Indochinese participation in the Indochinese economy.

C. France commits to ensure open market access to Indochinese goods in other French markets.

D. France commits to allowing the Indochinese population the opportunity to vote in a plebiscite regarding the political future of Indochina, with implementation of the chosen outcome not later than 1 September 1950. Such plebiscite shall include, as a minimum, the options of full independence and complete integration as a department of France.

Part 2: SATSUMA Commitments

A. SATSUMA commits to recognize and respect the existing boundaries of Indochina and the role of France, subject to the outcome of the plebiscite cited in 1D above, as the source of political and military authority within Indochina. SATSUMA will cooperate with France, in a mutually agreed upon manner, to preserve the well-being of Indochina where circumstances may require cooperation.

B. SATSUMA commits to supporting French commitments 1A through 1D in such manner as the parties may mutually agree upon.

C. SATSUMA commits to inviting Indochina to become an Associate Member of the South Asian Trade, Scientific Undertaking, and Military Accord, in which Indochina would receive all rights under Part II and Part IV of the Accord. At such time as Indochina may become sovereign, SATSUMA shall extend an invitation for Indochina to become a full Member of the Accord.

D. SATSUMA commits to providing free market access to Indochinese goods and services.

Part 3: Conflict Resolution

A. In the event that the parties disagree on the interpretation of any clause in this contract, an arbitration panel shall be appointed to resolve the dispute. The panel shall consist of a representative from France or Indochina, a representative from one of the SATSUMA signatories, and a chairman to be selected by the French/Indochinese and SATSUMA representatives.

B. Decisions rendered by the arbitration panel shall be binding.

Part 4: Duration of the Protocol

A.. The Protocol shall remain in effect until 1 September 1950, or until implementation of the chosen outcome of a plebiscite, at which time the parties shall meet to determine how the Protocol shall be replaced.
